When someone faces a drug charge in California, the outcome isn’t always a conviction followed by probation. The state has built specific alternatives designed to address drug dependency through treatment rather than punishment, and for qualifying defendants, those alternatives can produce a much better long-term result.

What Drug Diversion Programs Do

California’s drug diversion programs allow eligible defendants to complete a treatment program instead of facing traditional criminal prosecution. If they successfully complete the program, the charges are dismissed and no conviction enters the record. The criminal case effectively disappears.

This is a meaningfully different outcome than probation with a drug treatment condition. Standard probation results in a conviction that appears on background checks, affects professional licensing, and can impact immigration status. Diversion, when completed, doesn’t.

PC 1000 Deferred Entry of Judgment

California Penal Code Section 1000 governs the PC 1000 program, which applies to first-time defendants charged with simple drug possession offenses. Eligible defendants plead guilty, but sentencing is deferred while they complete a drug education or treatment program lasting 18 months. Upon successful completion, the charges are dismissed.

Eligibility requires no prior drug convictions or prior diversions within five years, no concurrent charge involving violence or threatened violence, and that the current offense be a personal use or possession charge rather than a sales or trafficking offense.

Proposition 36 Diversion

Proposition 36, passed by California voters, created another diversion pathway that applies to nonviolent drug possession offenders. Rather than jail, eligible defendants receive probation with a condition of drug treatment. Unlike PC 1000, Proposition 36 participants are convicted, but they avoid incarceration and the treatment focus gives them a pathway to compliance.

The key distinction is that PC 1000 avoids a conviction entirely, while Proposition 36 results in a conviction with treatment conditions attached.

Drug Court as an Alternative

Orange County also operates a Drug Court program, which provides structured supervision, frequent drug testing, and graduated sanctions and rewards for compliance. Drug Court is more intensive than standard probation but focuses on rehabilitation and, upon successful completion, often results in dismissal of charges.

An Irvine probation lawyer can evaluate which of these programs your situation may qualify for and help you understand which path produces the best outcome given your charge, your history, and your goals.

Why the Choice Between Diversion and Probation Matters

A conviction on your record affects far more than most people initially realize. Employment background checks, professional licenses, federal financial aid, and immigration proceedings all treat a drug conviction differently than a dismissed case. When diversion is available, it is almost always the better outcome.

Seyb Law Group handles drug defense cases throughout Orange County and understands how California’s diversion programs work in practice across different courthouses and with different judges.

If you’ve been charged with a drug offense in California and want to understand whether diversion is an option, speaking with an Irvine probation lawyer is a practical first step toward protecting your record.
